SLIP, TRIP AND FALL FRAUD: LOOK CAREFULLY BEFORE YOU PAY

Trip and Fall accidents are the most common sources of injury in the home and public facilities. The science related to trips and falls, surface finishes, shoe soles, and friction coefficients is mind-boggling to the average layman. Trip and falls, experienced by employees or guests, can be an expensive incident to those in the amusement industry, and frequently they are tough to defend.

The following are a few tips provided by Earl Dibble, of Safe Stride of the Ozarks, to help you recognize potentially fraudulent claims:

WORKER’S COMPENSATION (EMPLOYEE) CLAIMS: “RED FLAGS”
1. Loss reported several days after alleged incident
2. No witnesses to accident
3. Loss reported early on a Monday morning with no witnesses
4. Loss reported after notice of layoffs, cut backs or dismissal

GENERAL LIABILITY (GUESTS) CLAIMS: “RED FLAGS”
1. No medical objective findings — extensive treatment
2. No witnesses to the accident
3. Injured person creates a scene to draw attention
4. Witness is a relative or associate of injured party
5. Injured party pushes for quick settlement
6. Alleged to have slipped on a substance in an area where they shouldn’t have been
7. Injured party is from out of town and demands money to go to a doctor
8. Falls in open and obvious flaw in sidewalk, drive or parking area

The best defense for trip and fall incident is obviously prevention, even though you can’t regulate or enforce common sense. We suggest that you assign employee checklists, on a rotating basis, to review each room and area of your facility to identify potential hazards in order to develop a plan to eliminate as many as possible. Be prepared to defend yourself and your business investment.
